This newsletter (“Newsletter”) is owned and operated by Myriaccord LLC (“Myriaccord,” “Company,” “we, or “us”). By or using this Newsletter you agree to be bound by these Terms of Service (“TOS”), our Privacy Policy, and any additional policies applicable to specific areas of the Newsletter.

Accessing the Newsletter, in any manner, whether automated or otherwise, constitutes use of the Newsletter and your agreement to be bound by these TOS and your compliance with any applicable local laws. If you do not agree to these TOS, do not use the Newsletter.

Disclaimer

Tammy Lenski (“Tammy”) has a background in and knowledge related to conflict, conflict resolution, negotiation, and running a conflict resolution private practice. Tammy is not a psychotherapist, counselor, human resources manager, employment specialist, financial advisor, accountant, lawyer, medical doctor, business manager, or manager and neither this Newsletter or any information provided in the Newsletter by us or others replaces advice or counsel from any such professionals. You understand that Myriaccord has not promised, will not, nor shall be obligated to procure or attempt to procure business or sales for you or perform any business management or human resources functions for you.

Myriaccord and its subsidiaries, affiliates, officers, employees, agents, partners and licensors make no warranty that (1) the Newsletter or any other Myriaccord services will meet your requirements; (2) the Newsletter will be uninterrupted, timely, secure or error-free; (3) the results that may be obtained from the use of the Newsletter will be accurate or reliable; (4) the quality of any products, services, information or other material obtained by you through the Newsletter will meet your expectations; (5) new materials will be available at all or on any particular timeline; and (6) any errors in the software will be corrected. Any material downloaded or otherwise obtained through the use of the blog is accessed at your own discretion and risk, and you will be solely responsible for any damage to your computer system or loss of data that results from the download of any such material.

No advice or information, whether oral or written, obtained by you from Myriaccord or through or from the Newsletter shall create any warranty not expressly stated in the TOS.

Proprietary rights

The Newsletter is the product of countless hours of professional experience combined with many hours of writing and recording. This Newsletter is protected by copyright or other proprietary rights and laws and Myriaccord is the sole owner of that material. If you wish to obtain use permission to re-use, contact us.

Reliance on medical, legal, financial, investment and other information

The Newsletter exists for the purpose of sharing insight, knowledge, and experience via resources that are entertaining and educational. Please use your common sense and do not rely on any of the material found in the Newsletter for your specific legal, financial, educational, medical, or mental health needs. Those third-party services and sites are not governed by Myriaccord’s TOS or Privacy Policy, which do not cover collection, use, or disclosure by third parties through any applications, websites, products, or services that we do not control or own. Myriaccord does not review all content on these external sites and is not responsible for the quality of information provided by them.

Availability

Myriaccord reserves the right to discontinue the Newsletter or any of the paid membership benefits with or without notice at any time in our sole discretion. In the event of discontinuation, you will continue to have access to other available benefits until your current subscription period ends.

Cancellation and refunds

Myriaccord offers no refunds for monthly, annual, or patron-level membership, though you are welcome to cancel at any time and you will not be renewed at the end of your chosen membership period. We suggest you choose a monthly membership if you’re unsure whether or not an annual renewal plan is right for you.

Disclosures

Honesty and integrity matter to us, so we want to be forthright with you about the ways we earn income via this site. We primarily use this site to sell conflict resolution products, programs, and services.

We may be an affiliate for some products or services that we recommend. Affiliates receive a small percentage from any sale generated as a result of a link. We don’t promote a product or service we do not believe in when recommended and if our view changes about the product or service, we post an update or remove the recommendation. All links to Amazon.com are affiliate links. From time to time authors submit copies of their work for our review and merchants provide temporary access to their sites or products for the purposes of review. We disclose these circumstances to readers when they occur. We do not accept sponsored posts or advertising.

We also want to be forthright about the results you can expect from your use of this site. There are no miracles that will instantly transform conflict, relationships, or business. To get meaningful results, you will need to work hard, make a commitment to the changes you want to make and the successes you wish to have, and put ideas into regular practice. You should not infer promises or guarantees from quotes and results mentioned, nor should you infer any particular timeline. People are different from one another, and what one can achieve, another may not.

Indemnification

You agree to indemnify and hold Myriaccord and its subsidiaries, affiliates, officers, agents, employees, partners, and licensors harmless from any claim or demand, including reasonable attorneys’ fees, made by any third party due to or arising out of content you submit, post, transmit or otherwise make available through this Newsletter; your violation of the TOS, your violation of the rights of another, or your reliance upon information provided in the Newsletter which results in the third party claim against you.

Termination

Myriaccord may, under certain circumstances and without prior notice, immediately terminate your subscription to the Newsletter. Cause for such termination shall include, but not be limited to: (a) breaches or violations of the TOS or other incorporated agreements or guidelines; (b) requests by law enforcement or other government agencies; (c) a request by you (self-initiated account deletions); (d) discontinuance or material modification to the blog (or any part thereof); (e) unexpected technical or security issues or problems; (f) extended periods of inactivity; and/or (g) engagement by you in fraudulent or illegal activities. Further, you agree that all terminations for cause shall be made in Myriaccord’s sole discretion and that Myriaccord shall not be liable to you or any third party for any termination of any associated email address or access to the Newsletter.

Limitation of liability

You expressly understand and agree that Myriaccord and its subsidiaries, affiliates, officers, employees, agents, partners, and licensors shall not be liable to you for any direct, indirect, incidental, special, consequential or exemplary damages, including, but not limited to, damages for loss of profits, goodwill, use, data or other intangible losses (even if Myriaccord has been advised of the possibility of such damages), resulting from: (1) the use or the inability to use the Newsletter; (2) statements or conduct of any third party using the Newsletter; or (3) any other matter relating to the Newsletter.

Exclusions and limitations

Some jurisdictions do not allow the exclusion of certain warranties or the limitation or exclusion of liability for incidental or consequential damages. Accordingly, some of the above limitations of liability may not apply to you.

No waiver

Myriaccord’s failure to exercise or enforce any right or provision of these TOS shall not operate as a waiver of such right or provision. This means that Myriaccord may at any time choose to take an action that it is permitted or legally entitled to take, even if Myriaccord has not taken such an action in the past, in the same or a similar situation.

Enforcement

Myriaccord will take reasonable measures at our sole discretion to address activity not in accordance with this TOS or which we have good faith reason to believe may protect the safety of anyone or in instances where such disclosure is required by law. Such measures may include notification of and cooperation with law enforcement authorities.

Choice of law and forum

The TOS and the relationship between you and Myriaccord shall be governed by the laws of the State of New Hampshire without regard to any principles of conflicts of law. You agree to submit to the exclusive personal jurisdiction of the courts sitting in and for the county of Hillsborough, New Hampshire, United States of America to resolve any disputes arising from this Newsletter or these TOS.

Entire agreement

The TOS constitutes the entire agreement between you and Myriaccord and governs your use of the Newsletter, superseding any prior agreements between you and Myriaccord with respect to the Newsletter, with the exception of the Privacy Policy, which is addressed separately.
